February 14, 2011 Minutes
Meeting:        Salem Licensing Board held Monday, February 14, 2011 at 6:00 pm in the third floor conference room, 120 Washington Street. Present were members: Robert St. Pierre, chairman, members Rick Lee and John Casey, Investigator for the Board, Lt. Ouellette and Melissa Pagliaro, Clerk.
        
Approved:       Application for Sub-licensee Fortune Telling License for Magic Parlor. Applicant:  Wilma Houston. Present: Sharon Fagley, owner, Frank Fagley, manager and Wilma Houston.
        Mr. Casey asked the applicant to identify herself and tell the LB what she wants to do.
        Ms. Houston said that she has worked on and off in Salem for 20 years. She said she said she most recently worked for Coon’s as a reader and now she would like to work for The Magic Parlor.
        Mr. Lee motioned to approve.
        Mr. Casey seconded.
        Mr. St. Pierre said all were in favor. Motion carries.  

Approved:       Transfer of Manager for AOH, 104 Boston Street.
        Applicant: Shawn Carrick. Present: Tom Tardiff, current manager and Shawn Carrick.
        Mr. Tardiff said that on January 23, 2011 he gave his resignation letter to the Board, He said he has been doing this for 25 years and he is tired, he said it is time to bring someone new in.
        Mr. Casey asked if Mr. Carrick is TIPS certified.
        Mr. Carrick said that he is not right now but he is signing up for the class.
        Mr. Casey said that will be a provision of the transfer.
        Mr. Tardiff said that he is staying on temporarily until the transfer is approved so will be there to help Shawn during the transition.
        Mr. Casey said that the Manager must be there at least 40 hours a week.
        Mr. Tardiff said that is not going to be a problem and also noted that Mr. Carrick is living at 104 ½ Boston Street, right next door to the Club.
        Mr. Casey said for Mr. Carrick to arrange for his TIPS training and then to make sure that his servers and bartenders get certified as well.
        Mr. Lee said that there have been issues in lots of the restaurants and clubs with over serving. He said that AOH is not one but he just wants them to be very careful with over serving. He said that the Board is keeping a watchful eye on this problem.
        Mr. Tardiff said he does not think that there will be any kind of issues. He said they have not ever had any problems.
        Mr. Casey said that once the Manager is TIPS certified it could be a benefit as the club may get a discount in their insurance.
        Mr. Casey motioned to approve with the provision that the new manager get TIPS trained.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carries.

Approved:       Application for C/V License. Applicant: Michael Walsh for Café Jefferson, 272 Jefferson Ave.
        Mr. Walsh said that he is going to take over Café Jefferson, He said it is a great place and he wants to try to pursue this business now.  He said he has had 10 years of retail food experience and 20 years of business experience.
        Ms. Pagliaro said that are working together to get the rest of the paperwork together.
        Mr. Casey asked about the days and hours of operation.
        Mr. Walsh said that it would be the same as it is now. The hours will be from 6am-3pm, 7 days a week.
        Mr. Casey motioned to approve.
        Mr. Lee seconded.
        Mr. St. Pierre said that all are in favor. Motion carries.

Approved:       Application for a Transfer of a Wine and Malt License. Applicant: Scratch Kitchen, LLC d/b/a Derby Deli, 245 Derby Street. Present: William Fogerty, buyer, Judy Phillips, attorney for buyer and Jake Segal, attorney for sellers.
        Mr. Segal said that he told his clients to be present but he doesn’t know where they are.   
        Mr. Casey asked about the breakdown of the cost.
        Mr. Lee said you cannot out a price on the liquor license as it is a homerule license.
        Mr. Segal said the cost is $190,000.
        Lt. Ouellette asked what the price was for.
        Mr. Fogerty said the name, the client base and the reputation that is already established.
        Mr. Casey asked what Mr. Fogerty’s experience is in serving alcohol.
        Mr., Fogerty said that he has worked 16 years in kitchens. He said that he plans on being TIPS certified.
        Mr. Casey said there is usually a class to be certified that runs every week.
        Mr. St. Pierre asked if he is keeping the same staff that is own now.
        Mr. Fogerty said he is going to offer that to them and hopefully they will stay.
        Mr. Casey asked about the operating hours.
        Mr. Fogerty said that they will be 11am-8pm 7 days a week. He said in the beginning he might close on Sundays or Mondays just to give him self some time.
        ***Mr. St. Pierre noted for the record that Mr. & Mrs. Tsakis joined the meeting.
        Mr. Casey said it is a seven day license and he can close a day if he chooses to.
        Mr. Fogerty said the capacity will stay the same and gave a new menu for the file.
        Mr. Casey motioned to approve the transfer with the provision that the new owner become TIPS certified and then has other servers and bartenders become TIPS certified as well. Also, that there is a pledge on the license to Vasilios Takis, seller of the establishment for $90,000.00.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carries.

        Mr. Casey said that the Entertainment Application is for Live entertainment, limited to 5 pieces, radio, cd, and tv.
        Mr. Casey motioned to approve.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carries.

Approved:       Vote to approve 25% decrease in 2011 Seasonal License fees.
        Mr. Casey said that this is inline with what they did for the annual renewals because of the extra meals tax law that was passed.
        Mr. Casey motioned to approve.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carries.

Lt. Ouellette asked if someone could follow up with Beth Rennard or Jerry Parisella to see what the status is of the ABCC’s hearing for Strega. He said a lot of time and effort was put into that and it has been months and there has been no response.

Mr. Lee requested that Stromberg’s be called in for the February 28th meeting for a discussion o why the establishment has been closed.
